DMCA & Copyright Policy

XenonCloud respects the intellectual property rights of others and expects our customers to do the same. This page explains how we handle copyright infringement claims under the Digital Millennium Copyright Act (“DMCA”) and similar laws.

Submitting a DMCA notice

If you believe that content hosted on infrastructure operated by XenonCloud infringes your copyright, you may submit a written notification that includes the following:

  • Your full name, mailing address, telephone number, and email address.
  • A description of the copyrighted work that you claim has been infringed.
  • The exact URL(s) or sufficient information to locate the allegedly infringing material.
  • A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  • A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.
  • Your physical or electronic signature.

You can submit this information via our contact page with “DMCA Notice” in the subject line. We may provide an abuse-specific email address as part of our response for ongoing correspondence.

Our response to DMCA notices

Upon receiving a valid DMCA notice, XenonCloud may:

  • Contact the relevant customer and forward the notice details.
  • Disable access to or remove the allegedly infringing material.
  • Request additional information if the notice is incomplete or unclear.

In appropriate circumstances, and particularly in cases of repeat infringement, XenonCloud may suspend or terminate accounts associated with infringing activity, in accordance with our Terms of Service.

Counter-notices

If you are a XenonCloud customer and you believe material removed or disabled as a result of a DMCA notice is not infringing, you may submit a counter-notice. A valid counter-notice generally includes:

  • Your full name, mailing address, telephone number, and email address.
  • Identification of the material that has been removed or disabled and the location where it appeared before removal.
  • A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • A statement that you consent to the jurisdiction of the appropriate courts, and that you will accept service of process from the original complainant.
  • Your physical or electronic signature.

Important notes

XenonCloud is typically an infrastructure provider and does not control or pre-screen customer content. Our role in DMCA processes is to act on valid notices and counter-notices in a timely and balanced manner.
