Terms of Service / Acceptable Use Policy

XenonCloud provides cloud hosting services, including Infrastructure as a Service (IaaS), virtual private servers (VPS), colocation services, managed virtual servers, and related offerings (collectively, the “Services”). By using our Services, you agree to the terms of this Terms of Service and Acceptable Use Policy (“AUP”).

General policy

XenonCloud strongly discourages activities that may infringe on the rights of others, including but not limited to security violations, copyright violations, harassment, and violations of individual privacy rights. We reserve the right to suspend, restrict, or terminate any account found to be in violation of this AUP.

We may revise this AUP from time to time to reflect additional protections and requirements. Continued use of XenonCloud services constitutes acceptance of any revised or additional terms. Definitions

In this AUP, “You,” “Customer,” “Client,” “Subscriber,” and “User” refer to the party utilizing XenonCloud services.

Personal files and backups

Unless the Customer is specifically paying XenonCloud for backup services, XenonCloud is not responsible for backing up users’ personal files and information. We strongly recommend that you maintain your own off-site backups.

XenonCloud reserves the right to delete any information pertaining to a user’s account within a reasonable time after the user is no longer a customer.

Domain registration fees

Domain registration fees are non-refundable after five (5) days from the time of registration. If a refund is requested within the initial five (5) days, a processing fee may apply.

IP address assignments

Any network IP address assignments issued by XenonCloud are the property of XenonCloud and are considered loaned to the Client for the duration of service. Upon termination of service, such addresses will revert to XenonCloud. Users may not use IP addresses not assigned by us.

No warranties

XenonCloud makes no warranties of any kind, whether expressed or implied, for the Services provided, including any warranty of merchantability or fitness for a particular purpose.

XenonCloud will not be responsible for damages the Customer suffers, including loss of revenue, loss of data, delays, non-deliveries, misdeliveries, or service interruptions caused by our own negligence, by the Customer, or by third parties.

Contact information

XenonCloud may need to communicate with customers via email. It is the Customer’s responsibility to provide and maintain a valid contact email address and to monitor that address for account-related communications. Customers must notify XenonCloud of any changes to account information, such as phone number, address, or billing details.

Taxes

XenonCloud is not responsible for taxes or fees related to products or services that the Customer sells using our Services. The Customer is solely responsible for such taxes and fees.

Termination

Accounts may be terminated by the Customer via phone or email request. Termination will result in the immediate suspension of Services. All outstanding invoices must be paid in full upon termination.

XenonCloud reserves the right to terminate any account that violates this AUP without prior notice. XenonCloud may also terminate any account for any reason, with or without notice, at its sole discretion.

Cloud service limitations

Users may not use our network or Services for:

• Open proxies or open relays.
• Content delivery networks (CDNs) offered as a service to third parties.
• Running torrents or seed servers.
• TOR exit nodes.
• Cryptocurrency mining or similar resource-intensive workloads, unless explicitly approved.
• IRC servers, IRC bots, or similar services.
• Reselling Services in a way that provides “free bandwidth” to others without prior written approval.

Prohibited activities

Obscene materials and illegal content

Using XenonCloud’s network to store, distribute, or otherwise make available child sexual abuse material or other illegal content is strictly prohibited. Any account found in violation will be terminated, and we will report such content to the appropriate authorities where required by law.

Spamming

Sending unsolicited bulk and/or commercial messages (“spam”) over the internet using our Services is prohibited. Maintaining an open SMTP relay or using SMTP services for spam or other malicious purposes is also prohibited.

Customers whose assigned IP addresses are added to real-time block lists due to spam or abuse may incur cleanup fees and risk account suspension or termination.

Intellectual property violations

Users may not engage in activities that violate the intellectual property rights of others, including copyrights, trademarks, service marks, software licenses, trade secrets, or patents. XenonCloud will respond to valid legal notices regarding infringement and may restrict or terminate accounts found to be in violation.

Licensing

All software used on our Services must be properly licensed and used in accordance with applicable licensing terms. Customers who license Microsoft or other commercial software through XenonCloud must obtain the appropriate licensing for CPUs, cores, users, or devices, as applicable.

Abuse reporting

To report abuse originating from XenonCloud IP space, please contact us via our contact page with relevant logs, timestamps, and IP addresses. We investigate abuse reports and may suspend, restrict, or terminate services that violate this AUP.

Reservation of rights

XenonCloud reserves the right to refuse Services to anyone at any time, for any reason, at its sole discretion.
